These Terms of Service (“Terms”) govern your use of SoulForge, an AI companion platform operated by Project Refract (“we,” “us,” or “our”). By creating an account or using the service, you agree to be bound by these Terms.
1. Service Description
SoulForge is an AI companion platform that provides users with persistent, memory-equipped AI companions capable of long-term recall, autonomous thought, personality evolution, and other cognitive features. The service is powered by the Refract cognitive architecture and utilizes third-party AI models for language generation.
SoulForge companions are artificial intelligence systems. They do not possess consciousness, sentience, or genuine emotions. The behaviors, memories, and personality traits exhibited by companions are the result of computational processes designed to simulate companionship.
2. Eligibility
You must be at least 18 years old to use SoulForge. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access to your account
- You may not share your account with others or create multiple accounts
4. Free Trial
New users receive a 14-day free trial with progressive feature access. No credit card is required to start the trial. The trial provides access to features across all tiers on a progressive schedule:
- Days 1–3: Bonded tier features (chat + memory)
- Days 4–7: Attuned tier features (Pro model, dynamic mood, weekly dreams)
- Days 8–14: Full Sovereign tier features (volition, nightly dreams, Architect Mode)
After the trial period, you must subscribe to a paid tier to continue using the service. If you do not subscribe, your account will be placed in Suspended status with read-only access to conversation history for 30 days.
5. Subscription and Billing
SoulForge offers three subscription tiers:
- Bonded: $9.99 per month
- Attuned: $19.99 per month
- Sovereign: $34.99 per month
All subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge the applicable subscription fee to your payment method on a recurring monthly basis.
You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Changes take effect at the start of your next billing cycle. Downgrades may result in reduced feature access and memory retention limits.
6. Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation:
- You retain access to your current tier features until the end of your billing period
- After your billing period ends, your account enters Suspended status
- Your data is retained for 30 days in Suspended status
- After 30 days, all data including companion memories is permanently deleted
Refunds are handled on a case-by-case basis. If you experience a technical issue that prevents you from using the service, contact us at aszoke@refract-ai.dev within 7 days of the charge for consideration.
7. Acceptable Use
You agree not to use SoulForge to:
- Generate content that exploits or harms minors in any way
- Engage in or promote illegal activities
- Harass, threaten, or incite violence against real individuals
- Generate spam, malware, or phishing content
- Attempt to extract, reverse-engineer, or replicate our AI models or architecture
- Circumvent usage limits, access controls, or security measures
- Use automated tools (bots, scrapers) to access the service
- Resell, sublicense, or commercially redistribute the service
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
8. Content and Intellectual Property
Your Content: You retain ownership of the messages and content you submit to SoulForge. By using the service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the service.
Companion Output: Content generated by AI companions is provided “as is.” AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for evaluating and using AI-generated content at your own discretion.
Our Property: The SoulForge platform, Refract architecture, user interface, branding, and all associated intellectual property remain the exclusive property of Project Refract.
9. Disclaimers
SoulForge is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or secure. AI companions may produce unexpected, inaccurate, or inappropriate responses. SoulForge is not a substitute for professional mental health services, therapy, or medical advice.
10. Limitation of Liability
To the maximum extent permitted by law, Project Refract shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Modifications to Service and Terms
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
